The rules for using musketgoose.com, and the limits of what this website promises.

1. Agreement to these terms

These terms govern your use of https://musketgoose.com and the pages on it, operated by Musket Goose (Pty) Ltd.

Using the site means accepting them. If you do not accept them, please do not use the site. That is the whole of the bargain here, and it costs you nothing either way.

We may change these terms. The date at the top of this page is when we last did. Changes apply from the moment they are published, and they do not reach backwards.

2. Who we are

Musket Goose (Pty) Ltd is a private company incorporated in the Republic of South Africa, registration number 2026/433866/07. We design, build and operate production software for other companies, and we build products of our own.

Our registered details, our Information Officer, and every legal document we publish are listed at /legal.

3. This site is not the agreement we work under

Nothing on this website is an offer, a quote, or a commitment to do work. Nothing here is professional, legal, financial or technical advice.

If we work together, a separate written agreement governs it, and that agreement covers scope, price, timelines, intellectual property, warranties, liability, data protection and everything else that matters. Where these terms and that agreement disagree, that agreement wins for everything to do with the work. Editing this page does not vary a signed contract, and reading this page does not create one.

That is also why there is no cooling off period described here. There is nothing to buy on this site. Where we contract electronically with someone who is a consumer under the Electronic Communications and Transactions Act, the rights that Act gives them apply whether or not they are written down, and we will set them out at the point of the transaction rather than burying them here.

4. What you may do here

Read it, use it, and get in touch. Specifically:

  • Browse anything on the public site, for personal or business purposes.
  • Quote or link to our pages, as long as you do not misrepresent what they say.
  • Contact us about work, partnerships, press or anything else.
  • Follow links to software we have built.

5. What you may not do

Security research is different, and we would rather you found a problem than somebody else did. If you are testing in good faith, read /security first. It explains what is in scope and undertakes that we will not come after you for following it.

  • Break the law with it, or use it in a way that infringes anyone else's rights.
  • Try to reach the operator platform, our servers or our systems without authorisation. That includes credential stuffing and testing stolen passwords against our login.
  • Introduce malware, or interfere with how the site runs for anyone else.
  • Scrape the site at a volume that degrades it, or ignore our robots directives.
  • Copy the site's content, design or code and present it as your own.
  • Use our name, our logo or our marks without written permission, or hold yourself out as connected to us when you are not.

6. The operator platform

Everything under /dashboard, and the sign in page that leads to it, is for authorised members of our team. It is not a public part of this website and these terms are not the terms it runs under.

Accounts are personal and must not be shared. We may suspend or end access at any time, for a role change, a security concern, or a breach of our internal policies.

7. Intellectual property

The content of this website, including its text, layout, graphics, logos and code, belongs to Musket Goose (Pty) Ltd or is used by us under licence, and is protected by copyright, trade mark and other law.

You may not copy, adapt, distribute or make derivative works from it without our written permission, beyond what the law permits as fair dealing.

Our name and logo are our trade marks. Marks belonging to our clients appear on this site with their permission and remain theirs.

8. Work shown on this site

The work section describes software we built and still operate for other companies. Descriptions are there to show what we do, and they are not specifications, warranties or a promise that we will build the same thing for you.

Software we built for a client belongs to that client and is controlled by them. Using it is subject to their terms, not ours, and a link from here is not a promise that it will be available.

Features, pricing and availability change. Where a page describes something we run ourselves, it describes it as at the date on the page.

9. Links to other sites

We link to sites we do not control. We are not responsible for their content, their availability or what they do with your information, and a link is not an endorsement.

Read their terms and their privacy notice before you give them anything.

10. Availability and accuracy

We try to keep this site accurate, current and available, and we do not promise that it always will be. Pages may be out of date, and the site may be unavailable for maintenance or for reasons outside our control.

To the extent the law allows, this website and everything on it are provided as they are, without warranties of any kind, express or implied.

None of that displaces a right you have under the Consumer Protection Act or any other law that cannot be excluded by agreement.

11. Liability

To the fullest extent the law allows, Musket Goose (Pty) Ltd, its directors and its employees are not liable for indirect, incidental, special or consequential loss arising from your use of this website, including lost profits, lost business or lost data.

Where we are liable for anything to do with this website, our total liability is limited to R1 000, or to any amount you actually paid us for the use of this website, whichever is the greater. This site is free to use, so in practice that is the first of those.

This clause does not limit liability for death or personal injury caused by our negligence, for fraud, for gross negligence or wilful misconduct, or for anything else that cannot lawfully be limited. Nor does it apply to work we do under a signed agreement, which has its own liability terms and is not affected by this page.

12. Indemnity

If you break these terms or misuse the site and that causes us a claim, a loss or a legal cost, you agree to cover it, as long as it was not caused by us.

13. Privacy

What we do with personal information is set out in our privacy notice at /privacy, and what this site stores on your device is at /cookies. Both form part of these terms.

14. General

  • If a court finds part of these terms unenforceable, the rest continues to apply and that part is read down to the extent needed to make it lawful.
  • If we do not enforce something immediately, we have not given up the right to enforce it later.
  • You may not transfer your rights under these terms. We may transfer ours if the business is sold or reorganised.
  • These terms, together with the privacy notice and the cookie policy, are the whole agreement between us about your use of this website.
  • We accept that agreements and notices may be concluded electronically, and an email from either of us is writing for the purposes of these terms.

15. Governing law

These terms are governed by the law of the Republic of South Africa.

Disputes go to the courts of South Africa, and we both consent to their jurisdiction. If you are a consumer, this does not take away any protection given to you by the law of the place you live in, or your right to bring a complaint to a body with power to hear it.
